I would like to know if my partner can sell her car back to the seller, as we don’t need it any more.
She has bought a smaller car which we are happy with, and we would like to return the big car.
Rudolf Mahoney of WesBank responds:
This is a difficult question to answer because you have not provided us with any specifics.
If the car is financed with a bank, you are accountable for the debt that you have incurred. Having said that, you are allowed to sell the car as long as you are able to settle the outstanding amount on your account.
We also don’t know how much time (and mileage on the clock) has passed since you bought the car. Therefore, you should not have the expectation to sell the car for the same amount that you bought it for.
You are free to sell the car to anybody (not just the person you bought it from), but please make sure that you deal with a credible individual and/or a reputable dealership.
