Thank you for the enquiry. There is a legal exemption in terms of which no transfer duty is payable in a divorce, when a property is transferred from one spouse to the other. Your attorney will be able to assist with the transfer as part of the divorce settlement agreement, and no duties will be payable to SARS. The only costs will be legal fees, and you will need to establish value in order to process the sale.
