E-tolling: Is the ship sinking?

Cape Town - All is not well in the "e-tolling empire", says Fin24 user Jason Fivaz in response to the news that Sanral chairperson Tembakazi Mnyaka had resigned on Wednesday.

Fivaz, who said he had written to the Sanral executive on numerous occasions, wrote to Fin24 on Thursday that he couldn't contain himself when he heard that another Sanral executive had resigned "for personal reasons".

"I could not help but laugh at her 'personal reasons' excuse, as she is not the first senior executive within Nazir Alli's 'e-tolling empire' to suddenly give immediate notice, and resign for 'personal reasons'.

"My belief is that any person who is in fact close to the 'e-toll coal face' is now realising that 'the ship has struck an iceberg, and is taking on water fast'."

All except the ship's captain, Nazir Alli and his first mate, Vusi Mona, said Fivaz, "who appear to be standing at the helm of the stricken vessel, announcing over the intercom 'that all is alright, nothing has happened, we are still good to proceed. Next stop, Western Cape!"

"I wonder what the 'ship's' owners (our government) are thinking of this fiasco," he asked.

Fivaz said that over the past few years he had done a considerable ("and I mean a considerable") amount of writing to Alli and Mona about the unlawfulness of e-tolls, but "without being met with any real meaningful responses to his questions".

"So at some stage I considered to start including the chairperson of Sanral into my correspondence, as she is bound by her duty as chairperson to ensure that Good Governance and that The Rule of Law were met by the Sanral Board at all times."

"These letters were mostly CC’s on the back of my ranting to Alli and Mona. I took the specific opportunity to direct an email directly to the chairperson herself. (see below)

"Naturally I never received a response."

Fivaz included the email with links to the attachments he sent to Mnyaka.

As chairperson of Sanral you need to be made aware of some very urgent matters relating to e-tolling.

I have for the past few months been raising some critical issues in terms of the Constitutionality, Implementation and Operations of the Gauteng Open Road Tolling (Gort) System with Mr Nazir Alli. Unfortunately Mr Alli has been most uncooperative and displayed a reluctance to address my concerns.

As the chairperson of Sanral you are bound by fiduciary duties in respect of the correct and effective Governance, Code of Ethics, Social Responsibility and Compliance of Common Law Duties and Responsibilities in respect of all Business carried out by The Company, as well as the actions of its chief executive officer.

And this is why I am now raising these concerns with you.

I am sure you will understand and realise the severe ramifications that any adverse findings relating to the conduct of Sanral could have upon the individual Good Standing of its Board Members.

So with this in mind, I thought it prudent to bring your attention to the following;

These are but a few of the numerous emails that I have sent to Mr Alli, as I do not wish to bombard you with too much at first.

Please consider the possibility that the Gort is infringing upon the citizens of Gauteng’s Constitutional and Bill of Rights, as well as the Consumer Protection Act, and let me know if there is anything else that I can provide you with to properly address this matter.
