A Fin24 user, who pays the medical expenses of his ex-wife and daughter, writes:
I currently pay the medical expenses of my ex-wife and daughter. My ex-wife is the main member of the fund.
My ex wife and daughter are both dependent on me for financial support.
Can I claim these medical expenses in my tax return if the medical tax certificate has been issued in my ex-wifes name?
Marc Sevitz of TaxTim responds:
You can claim the medical aid expenses as you are supporting your former spouse and daughter, who are seen to be dependent on you for medical aid.
It would be advisable to contact the medical aid provider and have them re-issue the tax certificate in your name.
The medical aid provider could also provide a letter stating that the funds are received by you or from your account.
Then, if the South African Revenue Service does request further supporting documents, you can provide this to them along with the court order demonstrating you have to support your former spouse and daughter.
