Labour Q&A with Terry Bell
Fin24 user Sam Ncube questions the role of an HR manager being a presiding officer over a dispute hearing.
He writes: My question is whether a Human Resources Controller or Manager can preside over a disciplinary hearing when his/her role is to advise the parties in dispute.
The law may allow that perhaps but when the company policy has clarified the roles I find it contradictory.
Can you please advise
Terry Bell responds:
If the role of the HR person is to advise both parties in a disciplinary dispute, this would be contradictory.
However, depending on the nature of the dispute (who has been summoned and what the charge is about) the HR person could preside if not in any way directly involved.
Hope that's of help.
