Cape Town - The European Court of Justice has upheld a Stellenbosch company's right to use the name Waterford on its wines, attorneys said on Wednesday.
Leanne Mostert, a partner in the Cape Town firm Webber Wentzel, said the ruling handed down earlier this month followed a challenge by Irish glassware giant Waterford Wedgwood Plc.
She said her client, Assembled Investments, had wanted to register Waterford Stellenbosch as trade mark for its wines in Europe.
Waterford Wedgwood, which produces wine glasses, among other things, had argued that this would lead to confusion in the marketplace.
Mostert said the court ruled that even where a proposed trade mark was identical or similar to an existing one, confusion was likely only if the products involved were similar.
This was not the case with wine glasses and wine.
