Janine Myburgh, managing director of Myburgh Attorneys, responds:
You cannot go to jail for not paying your debts when there is a judgment against you.
You can, however, be liquidated, sequestrated, an emoluments attachment order placed on your salary or your assets attached.
The sheriff can, however, arrest you in the event that you have been ordered to court, for example, for a financial enquiry and you don’t go to court.
