A Fin24 user is having trouble paying a court ordered amount under debt review due to a change in circumstances. She writes:
I have been under debt review since 2009 and for at least the first four years paid the court ordered amount regularly.
My employment circumstances have changed and, although I continue to pay every month, I can no longer pay the court ordered amount.
I have also, in the meantime, settled one of the larger accounts under debt review when I received some unexpected funds.
My debt review councillor simply say that I have to pay the court ordered amount. If I do, I will not be able to eat and pay rent. Please assist.
Anel de Bruyn of Myburgh Attorneys responds:
In light of the fact that your circumstances have changed and the court order is no longer affordable to you, you can request that your debt review counsellor negotiate a new repayment plan.
In the event that your debt counsellor refuses to re-negotiate a new payment plan, you can approach a new debt review counsellor for assistance.
