Garnishee case: Fight against reckless lending continues

Johannesburg – The Constitutional Court’s ruling on Tuesday to have the issuance of garnishee orders by magistrates and not clerks of the court, will help correct past mistakes where consumers were prejudiced.

This is according to Clark Gardner, CEO of Summit Financial Partners, a financial services firm known for championing consumer rights. Gardner spoke to Fin24 following the handing down of the judgment.

“I think this is a resounding victory for those who are prejudiced. If you are a consumer you are protected. You have judicial oversight and you have a chance to defend yourself and oppose it,” he said.
