Labour Q&A with Terry Bell
A Fin24 user and employer, Johann le Roux, alleges that bodies like the CCMA have become legalised entities to extort money from employers. He writes:
As an employer I have seen the bargaining council dispute resolution councils and the CCMA evolve to become bodies legalised to extract money from employers that employees are NOT legally entitled to.
The dice is loaded against the employer. The smaller employers are particularly victimised by systems operated to dispense “justice” in a way that is anything but just.
Cases are allowed to proceed which are lodged months, even years, later than is prescribed by law for example.
Terry Bell responds:
Hi Johann
I think you would have a case to bring if you have any evidence of employees being granted money they are legally not entitled to.
In fact, the CCMA (Commission for Conciliation, Mediation and Arbitration) can only make an award (after arbitration) that can be challenged on review.
I would be very interested to hear of any cases being lodged that are beyond the legally prescribed limit.
