Fin24 user Ezekiel Semetsi wants to know does Numsa have a right to appeal its expulsion?
Terry Bell answers:
Yes, indeed, Ezekiel, Numsa has the right to appeal.
Any suspension or expulsion by the executive has to be ratified — and may be overturned — by a national congress. This is covered by clause 14.2 in the Cosatu Constitution.
Numsa and eight other unions, again in line with the Cosatu Constitution, called for such a congress 15 months ago and are now taking the matter to court.
Ezekiel: I think the tripartite alliance is still relevant because it exists and controls the government. But it has been badly weakened by the Cosatu turmoil. And the SACP, being probably the most severely damaged, is still active.ALSO WATCH: Undermining the ANC's power
