Labour Q&A with Terry Bell
Fin24 user Juan Botha is concerned that some striking workers are not aware that they are due back pay when they return to work.
He writes: “I read earlier that when striking workers return, they are due back pay in many instances. Most, I am sure, will be unaware of this”.
Terry Bell responds:
In annual agreements, the new rates of pay usually run from a particular month (say, July) to the same month the following year.
When disputes and negotiations carry on beyond those dates, the earlier rate of pay applies until a new rate is agreed.
The new rate should then be back paid to when the latest annual increment should have begun.
