Pretoria - A dispute over witness statements has resulted in Competition Tribunal cases against foam manufacturers, which had initially been separate, now being heard as one.

The charges against Loungefoam, Vitafoam and Feltex will be heard in combination because of concern about the application of an initial separation order.

The parties are being accused of directly or indirectly fixing the selling prices of their products, of dividing their markets among themselves and of having together negotiated the best prices to procure, for instance, chemicals.

A tripartite agreement also amounted to market division. Loungefoam and Vitafoam argue that they are a single economic entity because they are controlled by Steinhoff International.

The Competition Commission contends that at the Foam Forum the manufacturers resolved to fix the selling prices of their products.

The Commission also argues that the three agreed to impose trade restrictions on one another.

The Commission says that in 1999 Loungefoam and Feltex had entered into a trade-restriction agreement that would obtain for five years.

Loungefoam had appropriated the furniture foam market, and Feltex had focused on the automotive market.
