Cape Town - Thomas van Zyl, insolvency practitioner at Mazars, has managed to take into his possession numerous books and records of Beyers Realty Group.
Van Zyl was appointed as joint provisional liquidator on October 20 2016 and immediately convened a meeting with Thomas Makupo, the curator of the Beyers Realty Group Trust account. Makupo was appointed by the court on behalf of the Estate Agents Affairs Board (EAAB).
According to Van Zyl the books and records of Beyers Realty Group appear not to have been written up to date and are certainly not in order.
"I have also sent a letter to the directors' attorney requesting their assistance in the winding up. The attorney has responded by saying that his clients, being the directors, are residing in Australia together with their ten month old child born via surrogacy. I am further informed that one of the directors is allegedly returning to South African on November 16 2016," Van Zyl said in a statement.
"I have further established that the directors have entered into a sale agreement for the sale of their house in Blouberg, which is worth more than R6m and that they are in the process of selling their motor vehicles."
In order to protect the interests of the general body of creditors the provisional liquidators will be bringing an urgent application in the Western Cape High Court for an extension of their powers to urgently investigate the financial accounts of the company, including bringing applications for the sequestration of the estates of the directors.
Beyers Swanepoel-Trollip, co-owner of Beyers Realty Group, has denied that he has skipped the country.
Last week Fin24 was informed by a reliable source that Swanepoel-Trollip had left South Africa and creditors were worried about the impact it would have on pending court actions against the estate agency and Swanepoel-Trollip and his partner and husband, Lenard Swanepoel-Trollip, in their personal capacities.
"I am on a visit to Australia to sort out some serious issues with my spouse," Beyers Swanepoel-Trollip said in a statement issued on his behalf by his attorney, David Erleigh. Beyers Swanepoel-Trollip said he is due back in Cape Town on November 16 2016.
Four former estate agents of Beyers Realty have brought the application for the liquidation of Beyers Realty.
Beyers Swanepoel-Trollip has been proclaiming his innocence since he discovered that, about R6m was missing from the agency's trust account.
He claims he was responsible for the sales side of the business, while Leonard managed the finances along with a team of four.
"I have spent my lifetime marketing and selling real estate. This is not what I wanted for Beyers Group. I apologise to all who are inconvenienced, and assure you that I am in Cape Town doing my best to address the matter," Beyers Swanepoel Trollip said in the past.
