Court bid against Machanik postponed

Johannesburg - An application to stop estate agent Wendy Machanik Properties from operating was postponed in the High Court in Johannesburg on Thursday.

The Estate Agency Affairs Board (EAAB) was applying to the court to stop Wendy Machanik Properties from operating as an estate agent.

The matter was postponed to Tuesday for the EAAB to argue for its application, and for Wendy Machanik Property to argue a counter-application, SABC news reported.

Under the Estate Agents Act, an agent has to have a fidelity fund certificate to operate. The EAAB said Machanik does not have a certificate for 2011.

Portia Mofikoe, spokesperson for the EAAB, said the certificate had not been granted because they were waiting for the results of a forensic audit of the agency.

Last week, the EAAB successfully applied to place the agency's trust accounts under curatorship following alleged financial irregularities in the management of the accounts, Business Day reported on Wednesday.

City Press reported on Thursday that the EAAB had opened a docket against Machanik at the Norwood police station for allegedly stealing R25m from her agency's trust accounts.
