Durban - The ongoing dispute over which consortium should build Durban's 2010 Soccer World Cup stadium was adjourned until April 2 by the Durban High Court on Monday.

PG Mavundla Engineering and its partner co-operative Muratori Cementiti Di Ravenna, a leading Italian construction company with an annual turnover of R5.6bn, claim theirs was the lowest bid "by several million rands" and with its strong black economic empowerment component, it should have secured the contract.

Instead a consortium led by Group 5 was named as the preferred bidder, although no contract has been officially signed between the eThekwini Municipality and the consortium.

The PG Mavundla consortium are seeking to have the eThekwini municipality's tender process for the stadium reviewed by the court.

They were also seeking to have an interdict preventing any further work by the Group 5 consortium.

The adjournment was heard in chambers and the PG Mavundla consortium withdrew its application to halt any further work.

A short statement released later by attorneys for the consortium, read: "The Joint Venture does not wish to imperil Durban's position as a host city for the 2010 Soccer World Cup. It has therefore decided not to seek a court order which could delay construction.

"The Joint Venture, however, remains of the view that it should have been awarded the contract because it was the lowest tenderer and would have scored the highest empowerment points as well as completing the construction in the shortest time.

"In view of this the Joint Venture has resolved to proceed with an urgent review of the municipality's decision which will be heard on 2 April 2007."

Outside the Durban High Court a small protest was staged by members of the National African Federated Chamber of Commerce and Industry (Nafcoc) who held banners that said inter ailia "Nafcoc supports BEE for Local SMMEs".
